ELIGIBILITY The Contest is open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia (excluding Alaska and Hawaii) who are at least thirteen (13) years old on the date of entry. Employees of United States Tennis Association Incorporated (“USTA” or “Sponsor”), PrePlay, Inc., IBM, their respective sponsors, affiliates, subsidiaries, advertising and promotional agencies, any other agencies or entities involved with this Contest and members of their respective immediate families (parents, siblings, children, and spouse and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win. In the event of a dispute about the identity of any entrant, entries will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be required to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the entry. By participating in this Game, participants agree to be bound by these Official Rules. USTA reserves the right to disqualify from this Game any person it believes has violated these Rules.
A PARTICIPANT’S ENTRY INTO THE GAME WILL BE DEEMED TO BE A REPRESENTATION THAT PARTICIPANT: (i) IS 13 YEARS OF AGE OR OLDER; AND (ii) IF A MINOR IN HIS OR HER STATE OF RESIDENCE, IS ENTERING THIS GAME WITH THE PERMISSION OF A PARENT OR LEGAL GUARDIAN WHO AGREES TO BE BOUND BY THESE RULES. IF YOU ARE A PARENT OR LEGAL GUARDIAN AGREEING TO THESE RULES FOR THE BENEFIT OF A MINOR, YOU ARE FULLY RESPONSIBLE FOR HIS OR HER ENTRY IN THE GAME, INCLUDING WITHOUT LIMITATION ANY LEGAL LIABILITY THAT HE OR SHE MAY INCUR.
HOW TO ENTER Contest registration begins at 5:00 PM ET on August 11, 2018 Bracket selections must be competed and submitted between 1:00 PM ET on August 24, 2018 (or whenever the draw is) and 10:59 AM ET on September 2, 2018 (the “Submission Period”).
To enter the Contest, click the JOIN THE GAME button. Entrants must become registered users of the website in order to submit an entry. Follow the online instructions to become a registered user. Once registered, complete and submit during the Submission Period the seven-round US Open tournament bracket for the 2018 Men’s Singles Draw, the 2018 Women’s Singles Draw or both. Based on the tournament Round 1 match-ups, fill in your 127 winning selections for either or both of the 2018 Men’s Singles Draw and the 2018 Women’s Singles Draw. The number of rounds you fill out and the number of selections required will decrease proportionately as the tournament goes on, as users enter into different prize pools. In addition, for tiebreaking purposes, submit predictions for (1) the total number of points played in the final match, and (2) the length, in hours and minutes, of the final match for the corresponding tournament bracket.
Submissions that occur after 10:59 AM ET on August 27, 2018 will not be eligible for the Grand Prize, and will instead be eligible for different prizes, described below.
A user’s bracket will submit and lock at the beginning of the first match of the earliest round for which the bracket entry is fully completed. Unlimited changes may be made to submitted brackets up until that point. If, for any reason, a player withdraws from a match and is replaced in the bracket by another player, the replacement player will be substituted for the withdrawn player for the purposes of the Contest. If, for any reason, a player withdraws or retires from a match and is not replaced in the bracket by another player, for the purposes of this Contest that player will be considered to have lost any match he was scheduled to play in the event. In the event the tournament organizers make any material change to the draw after the Submission Period, the Contest may be deemed null and void.
For clarity, all brackets completed before the start of Round 1 of the US Open will be entered into the Grand Prize pool. Brackets completed after the start of Round 1 but before the start of Round 2 will be entered into the Round 2 Prize Pool. Brackets completed after the start of Round 2 but before the start of Round 3 will be entered into the Round 3 Prize Pool. Brackets completed after the start of Round 3 but before the start of Round 4 will be entered into the Round 4 Prize Pool.
Limit one (1) entry per person/valid email address (an entry may consist of a Men’s Singles bracket only, a Women’s Singles bracket only, or a Men’s Singles bracket and a Women’s Singles bracket). Additional entries will be disqualified. By entering, you agree to abide by these Official Rules. Once submitted, all entries become the sole property of Sponsor and will not be returned.
Mail-in Entries for Participants: Participants may also print the bracket and submit their bracket selection via mail, Attention: Digital Strategy and Partnerships, USTA, 70 West Red oak Lane, White plains, NY 10604. The submission must contain the participant’s name, address, telephone number, email address, and date of birth. Mailed entries must be postmarked by August 27th 2018 and received by September 3, 2018.
SCORING Points are awarded for each correct winning selection. The number of points awarded increases as the US Open progresses as follows:
- One (1) point for each correct pick in the first round
- Two (2) points for each correct pick in the second round
- Four (4) points for each correct pick in the third round
- Eight (8) points for each correct pick in the fourth round
- Sixteen (16) points for each correct pick in the fifth round
- Thirty-two (32) points for each correct pick in the sixth round
- Sixty-four (64) points for each correct pick in the seventh round
- Zero (0) points for each incorrect pick
A correct selection occurs when an entrant correctly picked the winning player that advances to the next round of the tournament (it is not necessary to accurately pick the player who the winner defeats in that match).
Points are accumulated separately for correct picks in the Men’s Singles Draw and for correct picks in the Women’s Singles Draw, and are not added together.
In the event of a tie, the two tiebreakers for the corresponding bracket are used (this tiebreaking mechanism will be employed when necessary at all prize levels):
- The entrant whose tiebreaker prediction for the total number of points played in the final match is the closest to the actual number without exceeding it will win. If all tied entrants exceed the correct answer
- If a tie still exists, the entrant whose tiebreaker prediction for the total length, in hours and minutes, of the final match is the closest to the actual number without exceeding it will win. If all tied entrants exceed the correct answer, the winner is determined by which of the tied entrants comes closest to predicting the actual number.
PRIZES: There are a total of eight (8) prizes available to be won; two (2) per Prize Period. For each Prize Period, the entrant submitting the Men’s Singles Draw bracket receiving the highest score and the entrant submitting the Women’s Singles Draw bracket receiving the highest score will each receive the prize respective to that round.
Round One (all bracket submissions prior to round one of the US Open): A three (3) day/two (2) night trip for two (2) to the 2019 US Open in New York, NY (exact dates to be determined by Sponsor). Trip consists of round trip coach-class air transportation for two (2) from a major U.S. gateway airport nearest winner’s residence (as determined by Sponsor, in its sole discretion) to New York, two (2) nights standard hotel accommodations (one (1) room, double occupancy), two (2) tickets to a day session during the first week of the US Open (exact day session to be determined by Sponsor) (the “Session”), and ground transportation between the New York airport and hotel and between the hotel and the site of the US Open (Approximate Retail Value (“ARV”) of trip prize: $3,550, each).
Actual value may vary depending on city of departure and dates of travel. Winner and guest are responsible for obtaining all required travel documents prior to travel. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice at least twenty-one (21) days prior to travel. Winner and guest must travel together on the same itinerary. Winner must be able to travel on dates specified by Sponsor or prize may be forfeited and Sponsor will have no further obligation to such winner. Certain travel restrictions may apply. Winner’s guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18 years of age) unless such guest is the child or legal ward of the trip prize winner. Winner is solely responsible for all federal, state and local taxes and any other expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all taxes, meals, gratuities, ground transportation, luggage fees and souvenirs.
Round Two (all bracket submissions after round one and prior to round two of the US Open): A $200 Gift Card.
Round Three (all bracket submissions after round two and prior to round three of the US Open): A $150 Gift Card.
Round Four (all bracket submissions after round three and prior to round four of the US Open): A $100 Gift Card.
All Gift Cards are subject to the terms and conditions of the respective Gift Card Company. Gift Card selection is at the sole discretion of the Sponsor and certain restrictions may apply.
Round One Prize winners will be issued a Form 1099, for income verification and tax purposes, for the retail value of the Prize. The Prize winner is advised to seek independent counsel regarding the tax implications of their respective prize winnings. In the event the Session or US Open is postponed or cancelled for any reason, no compensation or substitution will be provided for that portion; however, the remainder of the prize package will be awarded and Sponsor will have no further obligation to winner. Tickets are subject to certain terms and conditions specified by issuer. Seat locations will be determined by Sponsor. Winner and guest agree to comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of prize.
Limit one (1) prize per person. In the event the same entrant earns the highest score in both the Men’s Singles Draw bracket and the Women’s Singles Draw bracket, only one First Place trip prize will be awarded, however, such trip will be extended for an additional day and night (the “Upgraded First Place Prize”). Winner will receive an additional one (1) night’s hotel accommodations and two (2) tickets to an additional day session during the first week of the US Open (including ground transportation between the hotel to the site of the US Open) (ARV of the Upgraded First Place Prize: $3,850).
No substitution or transfer of prize is permitted, except that USTA reserves the right to substitute a prize of equal value or greater if the advertised prize is unavailable. All prizes are awarded "as is" and without warranty of any kind, express or implied, (including, without limitation, any implied warranty of merchantability for a particular purpose). Sponsor will not replace any lost, mutilated, or stolen prizes. Sponsor is not responsible if US Open is rained out or postponed, or cancelled after ticketing of prize for any reason, in whole or in part. In that event, the terms and conditions of the US Open tickets apply. No compensation will be paid in lieu of US Open ticket portion of prize. Prize is not transferable, assignable or redeemable for cash. All prize details are at Sponsor’s sole discretion. All taxes associated with the receipt or use of any prize are the sole responsibility of the winner.
WINNER NOTIFICATION Potential prize winners will be notified by telephone, email or regular mail within 30 calendar days after the conclusion of the Contest. Round One Prize winner(s) will also be required to sign and return an affidavit of eligibility along with US Tax Form 1099; guest of each Grand Prize winner will be required to sign and return the liability/publicity release (unless prohibited by law). If such guest is child or legal ward of winner, winner must execute and return all required documents on behalf of such child or legal ward. Round Two – Four Prize winners may be required to sign and return a Declaration of Eligibility and Release. A prize will be forfeited (i) if a potential prize winner cannot be reached within 7 calendar days from initial notification attempt, (ii) if a potential prize winner does not timely return the requisite documents, (iii) if prize is returned as non-deliverable, or (iv) in the event of non-compliance with any of the requirements of these Official Rules. In the event a potential prize winner is deemed ineligible or otherwise forfeits a prize (a “disqualified winner”), all entrants ranked below the disqualified winner will move up one (1) spot in the rankings and, in lieu of any prize such entrant may have been in line to receive prior to the disqualification of the higher ranked entrant, will be awarded the prize associated with such updated ranking, if any, subject to confirmation as a winner in accordance with these Official Rules.
RELEASE By participating in this Contest, each entrant and, by accepting a prize, each prize winner (i) agrees to be bound by the terms and conditions stated in these Official Rules, (ii) agrees to be bound by the decisions of USTA and judges, which are final and binding in all matters relating to the Contest, and (iii) agrees USTA, the USTA National Tennis Center Incorporated, the City of New York, Preplay Inc., and the IBM and their respective affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees, representatives and agents (collectively, the “Released Parties”) shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (including any travel or activity related thereto) or participation in this Contest. Entry and/or acceptance of a prize constitutes permission for USTA and its designees to use entrants’ and prize winners’ respective name, likeness, performance, hometown and state for advertising and promotional purposes in any and all media at the discretion of USTA without additional authorization, notice or compensation unless prohibited by law. If entrant is a minor in his/her state of residence, the minor’s parent or legal guardian also agrees to each of the provisions contained in this section.
INTERNET/TECHNOLOGY PROBLEMS Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), cable, satellite, website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. If for any reason the Contest (or any portion thereof) is not capable of running as planned, including infection by bugs, virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process and void all associated entries and/or to terminate, modify or suspend the Contest as necessary, and, if terminated, to award the prizes in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY INTERFERE, UNDERMINE, DAMAGE OR MANIPULATE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
MISCELLANEOUS Participants agree that this Contest is governed solely by the laws of the United States and the State of New York, and any claims arising out of this Contest may be brought only in a federal or state court located in the counties of New York or Westchester, New York. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Sponsor reserves the right, in its sole discretion, to modify these Official Rules at any time without notice. Sponsor reserves the right, in its sole discretion, to disqualify persons whose eligibility is in question or for any other reason whatsoever.
